83(b) election deadline and Form 15620

You have exactly 30 days from the transfer date. There are no extensions, and the IRS now provides an official form.

The 30-day rule

The election must be postmarked within 30 days of the property transfer — the purchase or grant date, not the vesting date. Miss it by a day and the election is void.

Form 15620

The IRS released Form 15620 as a standardised 83(b) election form. Mail it to the IRS service centre where you file your return, and give a copy to your company.

Proof of filing

Send by certified mail with return receipt and keep the postmarked receipt permanently. If the IRS has no record and you have no receipt, the election effectively never happened.
